Terms and conditions

Introduction

These are the terms and conditions that apply when you reserve a room at The RNLI College, Poole.

We reserve the right to amend these terms and conditions at any time and you should therefore check them each time you make a reservation. The terms and conditions applying to your reservation will be those in place on the date that you make your reservation.

Additional terms apply to your use of our digital channels whether you make a reservation through them. These are published on the relevant digital channel.

These Conditions set out your legal rights and responsibilities, our legal rights and responsibilities and certain key information which we are required by law to provide to Consumers (as defined in clause 1.1 below).

Your attention is particularly drawn to the provisions of clause 13 (Limitation of Liability).

Definitions and interpretations

1.1 Definitions

In these Conditions, the following expressions have the following meanings:

  • Business means any business, trade, craft or profession carried on by you or any other person/organization.
  • Conditions means these terms and conditions as amended from time to time.
  • Company/College/we/us/our means RNLI College Limited a company incorporated in England (with registered number 07705470 whose registered office is at the RNLI College, West Quay Road, Poole, Dorset, BH15 1HZ and who is the owner of the Hotel.
  • Consumer means an individual customer or Guest who receives Services for his/her personal use and for purposes wholly or mainly outside the purposes of any Business.
  • Hotel means RNLI College along with their premises and other type(s) of accommodation of which they are comprised.
  • Late Cancellation Charge has the meaning given in clause 10.
  • Rates means the prices payable by you for the provision by us of room accommodation and (where applicable) other Services.
  • Regulations means The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
  • Services means the provision of accommodation in rooms at the Hotel all other facilities, services and items offered by us.
  • VAT means United Kingdom value added tax (together with any replacement or equivalent tax).
  • Guest/you means a customer of the Company who agrees to pay as a paying guest of the Company and for members of his/her party and any of his/her guests.

1.2 Interpretation

In these Conditions:

1.2.1 a reference to a clause is a reference to a clause of these Conditions.

1.2.2 a reference to a ‘party’ refers to the parties to the Agreement and includes that party’s personal representatives, successors and permitted assigns.

1.2.3 a reference to a ‘person’ includes a natural person, corporate or unincorporated body (in each case whether having separate legal personality) and that person’s personal representatives, successors and permitted assigns.

1.2.4 a reference to a ‘company’ includes any company, corporation or other body corporate, wherever and however incorporated or established.

1.2.5 words in the singular include the plural and vice versa.

1.2.6 any words that follow ‘include’, ‘includes’, ‘including’, ‘in particular’ or any similar words and expressions shall be construed as illustrative only and shall not limit the sense of any word, phrase, term, definition or description preceding those words.

1.2.7 a reference to ‘writing’ or ‘written’ includes any method of reproducing words in a legible and non-transitory form; and

1.2.8 a reference to legislation is a reference to that legislation as amended, extended, re-enacted or consolidated from time to time and includes all subordinate legislation made from time to time under that legislation.

2. Reservations

To reserve your room please follow the instructions on the website, mobile site or app (as applicable).

You must be at least 18 years old to make a reservation. Those under 18 years old are not permitted to stay at The RNLI College unless a parent or guardian is also staying in the hotel. See section 5 “Occupancy” below for details of permitted guests under your booking.

When you request us to make a reservation, you must provide us with your identification information including, but not limited to, your name, address, contact telephone number and email address.

You will need to provide your credit or debit card (which must be valid beyond the date of your intended stay) details to secure your reservation. RNLI College accepts Visa, MasterCard, Maestro, American Express to secure a reservation.

Please check that the details of your reservation are complete and accurate before you confirm your reservation. We will not be liable for any delay or non-performance if you provide us with incorrect information.

Your request to us to make a reservation for you will constitute an offer by you to purchase the Services but whether we accept any such offer will be for us to decide in our discretion

. We will confirm our acceptance of your reservation by sending you an email to the email address that you provide during the reservation process. The contract between us for the provision of your room and any additional services added to your reservation will be formed when you receive this email confirmation from us.

If you think that there is a mistake in your reservation or if you require any changes to a confirmed reservation, please contact us on [email protected]  to discuss. For more information on cancellation, please see section 10 Cancellation, below.

3. Group reservations

For bookings of 5 rooms or more, call our Central Reservations team on 0300 300 7654. Lines are open Monday - Friday 7am - 10pm. Calls are charged at the national rate. 

The prices shown online are for bookings of up to 4 rooms. Room rates may be different for group bookings depending on the number of rooms booked. 

4. Room prices

When you make a reservation request, we'll give you a total price for the rooms and number of nights you've requested. The price you pay is the price quoted to you at the time you make your reservation.

Room prices are per room, per night and are inclusive of VAT at the applicable rate at the time of your reservation. If the rate of VAT changes between the date of your reservation and the date of your stay, we may adjust the rate of VAT but the price you pay will remain the same. Up to two children (under 16) may stay with one full paying adult in our rooms.

All prices are based on Bed & Breakfast; other extras are not included in the room price, but you may be able to add them to your reservation during the booking process or they may be available to you during your stay. You may pay for selected extras at the same time as paying for your room. If you have breakfast and selected extras as part of your reservation and the rate of VAT changes between the date of your reservation and the date of your stay, we may adjust the rate of VAT, but the price you pay will remain the same. All other meals and extras must be paid for separately.

Payment in full is required on check in for all bookings. Please see section 10 Cancellation for full rate restrictions.

5. Occupancy

We have 60 bedrooms at the RNLI College. The maximum room occupancy is two adults and two small children up to the age of 10 or 1 large child up to the age of 17 years. There must always be a person over the age of 18 staying in each room.

You must not exceed the maximum occupancy for the room allocated to you. We reserve the right to conduct checks on occupancy and compliance with these terms. Occupancy is not transferable.

Those under 18 years old are not permitted to stay at The RNLI College unless a parent or guardian is also staying in the hotel. We reserve the right to request valid photographic proof of identity and age, so please bring this with you and ensure all guests under your booking bring identification, otherwise where requested you and/or your guests will not be permitted to stay.

The RNLI College management, housekeeping and/or maintenance staff may access any RNLI College room(s) as and when required by The RNLI College, with housekeeping permitted full access at least once every two days. Entry may also be required where there is suspicion of any circumstances that may amount to a breach of these Terms by you or any person in the room or for reasons of security or safety.

We reserve the right to change your room allocation at any point during your stay for any reason

6. Accessibility

The RNLI College have 3 rooms which are specially adapted for customers with disabilities. These rooms are subject to availability.  If this room is not showing on the website for your dates, this is because the room type is unavailable.

7. Special requests

Although The RNLI College will try to accommodate special requests, all rooms/requests are subject to availability.

8. Meals

Breakfast is included in the room price as standard.

If you would like to dine in our restaurant for lunch or dinner, we recommended that you pre-book to avoid disappointment. You can also check on the day to see if we have any availability. 

9. Paying for your room

The cost of all rooms is payable in full on arrival. If you cannot pay on arrival, we will be unable to check you in.

Payment may be made by cash, credit/debit card (Visa, MasterCard, American Express, Maestro and Electron). The expiry date of your debit/credit card must be later than the end of your stay. We do not accept personal cheques or family discount cards.

RNLI gift vouchers may also be used when paying upon arrival.

We do not give change from RNLI gift vouchers. The RNLI gift voucher terms and conditions which are stated on the voucher will apply.

10. Cancellation

Your right to cancel

Room bookings may be cancelled before 2pm United Kingdom (UK) time on the day before your arrival date at no cost. If you cancel your reservation before 2pm on the day before arrival, no payment will be deducted from your card. A cancellation email should be requested and should be retained as proof of cancellation.

If you cancel a reservation after 2pm UK time on the day before arrival (including any "no show") you will be charged a cancellation charge equivalent to one night's total accommodation per room booked for the first night of your stay. A cancellation email should be requested and retained as proof of cancellation. Such cancellation charge is to compensate the hotel for the late cancellation and inability to re-sell the room. The payments is not for any service.

If you decide to shorten your stay you must inform reception at The RNLI College by 2pm the day before, otherwise you will be charged a cancellation fee equivalent to one night’s total accommodation per room booked. Such cancellation fee is to compensate the hotel for the late cancellation and is not for any service.

The first night of any booking made after 2pm UK time on the day of arrival and the cost of any and other extras booked for the following day is non-refundable in the event of a cancellation (including any "no show").

You can amend a booking up until 2pm UK time on the day before arrival.

Our right to cancel

Your breach

We may cancel your reservation at any time with immediate effect by giving you written notice (which includes email) if:

  • you do not pay us when you are required to do so; or
  • you breach the contract between us in any way; or
  • you have previously breached the contract between us in any way.

If we cancel your reservation where you are at fault, we reserve our legal rights in respect of your breach of contract. Where your stay had/has not yet commenced, the total payment made or to be made by you for such room shall be deemed a cancellation charge and is not for any service.

Events outside our reasonable control

We may also cancel your reservation if an event outside of our reasonable control (including without limitation industrial action, explosion, outbreak of disease, pandemic, health and safety issues, fire, flooding, and failure of power and/or water supplies or emergency evacuation, industrial action) means that we are unable to make your room available to you. In this case we will contact you to let you know as soon as possible.

Save as set out above, we will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by an event outside of our reasonable control. This does not affect your statutory rights.

11. Arrival and departure

Check-in time will be from 2pm and check-out is by 11am. Please note that during some of our busiest periods, there may be a wait at check-in. 

Guests will be asked to provide proof of identity and nationality upon check-in. Guests will be asked to complete a registration form and provide their identity card / passport details. Acceptable forms of identification are a passport, driving licence, or government issued ID card.

Rooms must be vacated by 11am on the day of departure. Failure to leave your room by this time may result in a late check-out charge of up to one night's additional accommodation charge.

12. RNLI College expectations of you (and your group)

You must not:

  • be threatening, insulting or abusive to any of our team before, during or after your stay.
  • smoke anywhere inside The RNLI College. This includes the smoking of e-cigarettes. We have a permitted smoking area near reception, please ask for the location.
  • engage in any unlawful activity during your stay at The RNLI College premises (e.g. taking an illegal substance).
  • cause any health and safety hazard to any of our team members or any of our guests.
  • bring any pets onto The RNLI College premises, except for assistance dogs; We will request proof that the dog is an assistance dog. If this cannot be supplied, we will be unable to allow the booking to go ahead.
  • bring any potentially dangerous or hazardous materials or equipment onto The RNLI College premises.
  • use any electrical appliances that may set off the fire alarm system, such as toasters, mini cookers or portable grills.
  • tamper with any fire alarms or emergency equipment.
  • utilise RNLI College rooms to store items (personal or otherwise) which could in the sole opinion of The RNLI College cause damage to the room or be a risk to the health and safety of staff or property.
  • prevent The RNLI College management, housekeeping and/or maintenance staff from access to your RNLI College room(s) as provided in clause 5
  • remove, damage or destroy any RNLI College property.
  • use any of the technology provided by The RNLI College to download or access any unlawful or obscene material; or cause unreasonable disturbance to our other guests or any RNLI College staff.

If you or your group cause damage or loss of any kind to the hotel, other guests or their property, you (as the person making the booking) will be responsible for that damage or loss and you shall be liable to pay to The RNLI College on demand the amount required to make good or remedy such damage or loss. For the avoidance of doubt, if The RNLI College requests that you or any member of your group are to leave the hotel following a breach of these terms and conditions, you will also be liable to pay The RNLI College on demand all costs associated with such removal. 

You and the members of your group must not resell or transfer your reservation (or any part of it) nor advertise, market or otherwise offer any The RNLI College room for sale either on its own or as part of a combined offer. The RNLI College will not honour any reservations made in this way and does not accept any liability for doing so.  

If you or your group cause damage to the hotel, other guests or their property, or otherwise breach any of these terms and conditions, The RNLI College reserves the right to:

  • cancel your reservation with immediate effect and (if appropriate) eject you from The RNLI College premises.
  • cancel key cards.
  • restrict access to the hotel.
  • retain all sums paid by you and/or charge you the full amount of your reservation
  • charge you the appropriate cost to replace/repair all items that you have damaged
  • refuse future reservations from you and/or refuse you entry to The RNLI College

The RNLI College will not be liable for any refund or compensation in such circumstances.

The RNLI College reserves the right to decline or cancel reservations made and stays in progress by those who have previously breached these terms and conditions (as may be updated from time to time), whether the reservation is in that name or not.

13. Limitation of Liability 

13.1 We will be responsible for any foreseeable loss or damage that you may suffer as a result of our breach of these Conditions or as a result of our negligence. Loss or damage is foreseeable if it is an obvious consequence of our breach or negligence or if it is contemplated by you and us when our contract with you is created. We will not be responsible for any loss or damage that is not foreseeable.

13.2 Nothing in these Conditions will exclude or limit our liability for death or personal injury caused by our negligence (including that of our employees, agents or sub-contractors) or for fraud or fraudulent misrepresentation.

13.3 We provide all Services only for your personal and private use/purposes. We make no warranty or representation that products, or other goods or materials that we provide, or sell are fit for commercial, business, industrial, trade, craft or professional purposes of any kind (including resale). We will not be liable to you for any loss of profit, loss of contract, loss of commercial opportunity or any indirect or consequential loss or damage.

13.4 Nothing in these Conditions is intended to or will exclude, limit, prejudice or otherwise affect any of our duties or obligations to you, or your rights or remedies, or our liability to you, under the Regulations or any other consumer protection legislation as amended from time to time.

13.5 Subject to clause 10.2, we shall not be liable, whether in contract, tort (including negligence) or for breach of statutory duty, or in any other way for any of the following: loss of profits, loss of sales or business, loss of agreements or contracts, loss of anticipated savings, loss of or damage to goodwill, or indirect or consequential loss.

13.5 Subject to clause 13.2, our liability to you arising out of the provision of Services to you under these Conditions shall not exceed the value of the booking in respect of any one claim or series of related claims.

14. Third Party Rights 

This contract formed when we confirm your reservation is between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise.

15. Your rights

If you are a Consumer, we are required by the Regulations to ensure that certain information is given or made available to you as a Consumer before we make our contract with you (i.e. before we accept your request to make a booking). We have included the information itself either in these Conditions for you to see now or we will make it available to you before we accept your request to make a booking. All information will, as required by the Regulations, be part of the terms of our contract with you as a Consumer. Nothing in these terms and conditions is intended to affect those rights.

16. Personal data

All personal information provided by you will be collected, processed and used in line with the our privacy policy, which explains what personal information we may collect from you, how and why we collect, store and use and share such information, your rights in relation to such personal information and how you can contact us and any supervisory authority if you have a query or complaint about the way in which we use any personal information. A copy of the privacy policy can be made available. We reserve the right to collect such personal data as is necessary to ensure our compliance with current government guidelines, orders and similar. This includes but is not limited to biometric data such as your temperature, where such data collected in accordance with the relevant data protection legislation which is in force from time to time in the United Kingdom. Such data will be collected for the sole purpose

17. Applicable law and Jurisdiction

These terms and conditions, their subject matter and formation (and any non-contractual disputes or claims) are governed by and construed in accordance with English law and any claim is subject to the jurisdiction of the English courts.
