 RNLI LIFE KÄRCHER 2024 PRIZE DRAW TERMS AND CONDITIONS (“TERMS AND CONDITIONS”)

1. General

1.1 These Terms and Conditions are applicable to anyone entering the online “RNLI Life Kärcher 2024 Prize Draw” (the “Prize Draw”) promoted, administered and run by us, the Royal National Lifeboat Institution (RNLI), a charity registered in England and Wales (209603), Scotland (SC037736), the Republic of Ireland (CHY 2678 and 20003326), the Bailiwick of Jersey (14), the Isle of Man (1308 and 006329F), the Bailiwick of Guernsey and Alderney, of West Quay Road, Poole, Dorset, BH15 1HZ (the ”Charity” and “us”).

1.2 By entering the Prize Draw you (“You”, the “Entrant”) expressly accept these Terms and Conditions and agree to be bound by them. It is a condition of entry that these terms and conditions are accepted and that the entrant agrees to abide by these terms. If You do not want to accept the Terms and Conditions, You should not enter the Prize Draw.

1.3 The Charity reserves the right to refuse entry or refuse to award the Prize to anyone in breach of these Terms and Conditions.

1.4 The decision of the Charity regarding any aspect of the Prize and the Prize Draw is final and binding and no discussion or correspondence will be entered into about it.

2. Prize Draw

2.1 The Prize Draw is promoted and run by the Charity.

2.2 The Prize Draw is free to enter. There is no obligation to make a donation to be eligible for entry.

3. Eligible Entrants

3.1 All entrants must be 18 years old or over;

3.2 You must be a resident of either: UK, Ireland, Isle of Man or Channel Islands;

3.3 In entering the Prize Draw, You confirm that You are eligible to lawfully enter the Prize Draw and to claim the Prize. The Charity may require You to provide proof that You are eligible to enter the Prize Draw; and

3.4 Employees and volunteers of the Charity directly involved in running the Prize Draw cannot enter into the Prize Draw.

4. Prize

4.1 Subject to these Terms and Conditions, there will be 1 winner, and they will receive their choice of either a Kärcher Mobile Cleaner OC 3 or a Kärcher Mobile Cleaner OC 3 Foldable (the “Prize”).

4.2 The Prize is non-exchangeable, non-transferable and no cash alternative is offered.

4.3 The Charity reserves the right to substitute a Prize with an alternative and equivalent prize at its sole discretion.

4.4 Descriptions of the Prize and the Prize itself are provided without a warranty of any kind. RNLI is not a manufacturer of the Prize and makes no guarantee as to their quality. Please refer to the manufacturers guidelines on how to use the Prize. In no event shall the Charity (including its employees, affiliates and volunteers) be liable for any claim, demand or damages arising out of or in any way connected with the use by the Entrant of the site, the Prize Draw or their use of a Prize.

4.5 The Prize may only be redeemed by the winner. Offer is limited to one prize per valid entry.

4.6 The Prize will be sent to the winner as soon as practicable after the Prize Draw.

5. How to enter

5.1 To enter this prize draw, entrants must fill in this form: Win a Karcher Mobile Cleaner Form.

5.2 Please note that this is the only method by which to enter the prize draw. Entries submitted in any other way will not be accepted.

5.3 On completing the Form, you will receive an email confirmation, which will be accepted as proof of receipt of entry to the Prize Draw.

5.4 The entries must be submitted from 09:00 (BST) on the Opening Date (being 14 August 2024) until midnight (BST) on the Closing Date (being 28 August 2024). All Prize Draw entries received after the Closing Date are automatically disqualified.

5.5 Only one entry per person can be submitted.

5.6 Entries that do not comply with these Terms and Conditions or which exceed the maximum number of entries will be void and will not be entered into the Prize Draw.

6. How the winner is determined

6.1 All correct entries will be entered into the Prize Draw and the winning entrant will be selected at random by a computer number generation process that produces verifiably random results.

6.2 The decision as to the winner shall be final and no discussions will be entered into.

7. Personal data

7.1 The Charity will process your personal data for the following purposes: to process entries, liaise with the Prize Givers, contact you at the close of the Prize Draw if you have won, give full details of your prize, tell you how to obtain the prize, and/or send you the Prize.

7.2 Personal data supplied during the course of this promotion may be passed on to third-party suppliers for the purposes of fulfilment/delivery/arrangement of the prize if necessary or if required to do so by law.

8. Contacting the winner

Within 72 hours of the Prize Draw closing, the winner will be contacted by the Charity using the email address provided by the Entrant.

9. Winner announcement

The Charity may announce the first name and county of a winner on its website, social media, Compass, Horizon and Volunteer Facebook unless the winner objects to it in accordance with paragraph 13.

10.  Eligibility checks

The Charity reserves the right to verify the eligibility of entrants. The Charity may require such information as it considers reasonably necessary for this purpose and a Prize may be withheld unless and until the Charity is satisfied with the verification.

11.  Entrant only

All entries must be made by the entrant themselves and not on behalf of anyone else. Bulk entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries, entries by macros or other automated means (including systems which can be programmed to enter), and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that an entrant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that entrant’s entries into the Prize Draw in a way that is not consistent with the spirit of the Prize Draw that entrant’s entries will be disqualified and any prize award will be void. 

12. Lost or Damaged entries

No responsibility is accepted for entries lost, damaged or delayed or as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.

13. Publicity

13.1 The Charity may make the winner’s entry available on its website or other media and can use the winner’s names or county of residence to announce the Prize Draw winner.

13.2 If you object to your information being published if you win or want to reduce the amount of information published please contact [email protected].

14. Complaints

All disputes or complaints relating to the Prize Draw should be referred to the Charity at [email protected]. Please include the details of the Prize Draw, the Charity and the nature of your complaint and we will respond to Your complaint within 14 days of receipt. If your query or complaint relates to a data protection issue, then please email our Data Protection team at [email protected]

15. Limitation of Liability

15.1 RNLI is not a manufacturer of the Prize and makes no guarantee as to its quality. Please refer to the manufacturer’s guidelines visible on the Prize or its packaging on how to use the Prize.

15.2 Insofar as permitted by law the Charity or its agents will not in any circumstances be responsible or liable to compensate the winner or an entrant or accept any liability for any loss or damage or injury occurring as a result of taking up the prize or taking part in the Prize Draw except where it is caused by the gross negligence of the Charity or their agents, distributors or employees.

15.3 The Charity acting reasonably reserves the right to void, suspend, cancel or amend the Prize Draw and these Terms and Conditions where it becomes necessary to do so.

15.4 In no event shall the Charity (including their employees, affiliates and volunteers) be liable for any claim, demand or damages arising out of or in any way connected with the Entrant’s use of the site, the Prize Draw or their receipt and use or enjoyment of the Prize.

15.5 The Charity will not accept responsibility for competition entries that are lost, mislaid, damaged or delayed in transit.

16. Variation of Terms

The Charity may vary these Terms and Conditions.

17. Third Party Rights

No person who is not a party to an Agreement shall have any right pursuant to the Contracts (Rights of Third Parties) Act 1999 to enforce any term of such Agreement.

18. Applicable Law

These Terms and Conditions are governed by English Law, and the Entrants submit to the exclusive jurisdiction of the courts of England and Wales.

19. Refunds Policy

The Charity does not provide refunds of donations. Monies are raised for the Charity and go towards the Charity’s purpose. However, where there is a valid complaint and the Charity deems that a refund or part refund is appropriate the Charity will liaise directly with the Entrant. All complaints must be referred to the Charity at [email protected] in the first instance.

20. Shipping Policy

The Prize will be shipped to the winner by Kärcher.
